Definitions & Interpretation

In these Terms and Conditions, the following terms shall bear the meanings assigned to them below, unless the context clearly indicates otherwise:

• "the Group" / "B Shocked Group" means B Shocked Group (Pty) Ltd, a private company duly incorporated in accordance with the laws of the Republic of South Africa, and its subsidiaries.
• "Subsidiary" / "Subsidiaries" means B Shocked Electrical (Pty) Ltd, Rick Interiors (Pty) Ltd, and B Shocked Wealth Harbour (Pty) Ltd, each being a distinct legal entity operating under the oversight of B Shocked Group (Pty) Ltd.

Client Verification & Fraud Prevention

The Group and its Subsidiaries operate in an environment where phishing, email spoofing, and business email compromise are increasingly sophisticated and prevalent threats. The following security measures are in place to protect all parties:

Client Profile Requirement: Due to the increasing sophistication of phishing, spam, and social engineering attacks, the Group requires all new clients, prospective partners, and stakeholders to complete a brief client profile setup before entering into any commercial engagement. This enables the Group to verify your identity, confirm your authorised representatives, and protect all parties from fraudulent dealings.

If you are unable to complete the profile setup digitally, or if you have received any communication purporting to be from the Group that causes concern, please contact us telephonically immediately using the verified contact details published on this Website or the relevant Subsidiary's website.

• Do not act on any email instruction involving payment, banking detail changes, or contract amendments without telephonic verification.
• Do not share sensitive business or personal information in response to unsolicited email requests.
• Report any suspicious communication purportedly from the Group to us immediately.

B Shocked Group (Pty) Ltd reserves the right to amend, update, or replace these Terms and Conditions at any time and without prior notice. Section 12

Governing Law & Disputes

These Terms and Conditions are governed by and shall be interpreted in accordance with the laws of the Republic of South Africa. The parties consent to the jurisdiction of the South African courts in relation to any dispute arising from or in connection with these Terms and Conditions.

In the event of a dispute, the parties agree to first attempt resolution through good-faith negotiation. Should negotiation fail within 20 (twenty) business days of written notice, either party may refer the matter to mediation before a mutually agreed mediator. Failing resolution through mediation, the matter shall be referred to arbitration in accordance with the Arbitration Act 42 of 1965, as amended, unless either party elects to approach a court of competent jurisdiction.

Nothing in this clause shall preclude either party from seeking urgent or interim relief from a court of competent jurisdiction.

In the event the Group is required to take legal action to enforce any right or recover any amount, you shall be liable for all legal costs on the attorney-and-own-client scale, including collection commission and tracing fees where applicable.
